Hill St. Los Angeles CA 90015 January 18, 1996 re: Inquiry no. 95-41592 Mx. xxx, I am still puzzling over your letter dated January 2 in regard to my complaint about California attorney Kendrick Moxon (through his assistant Lynn Farny) stealing my property and threatening to raid and sue me. You refer to "your case", wherein I could have my grievances aired, but I have no case. I was deposed for someone else's case. If you are talking about Judge Brinkema's referral to Judge Jones for an Order of Protection (which I sent a copy of Judge Brinkema's referral), that was where Judge Brinkema on her own saw my predicament concerning CD's Mr. Moxon wanted me to hand over and attempted to make sure no more of my property was stolen. The result was that Judge Jones made a Stipulation in which copies of my CD's in question would be made and I would have my CD's mailed back to me. So it appears to me that Judge Brinkema took Kendrick Moxon's actions much more seriously than you have. You state that "if the court finds professional misconduct on the part of the attorney, it may refer the matter to our office for further investigation." But again, there is no judge in my "case" because I am not in any "case." Does this statement mean that attorneys can get away with the actions that Lynn Farny and Kendrick Moxon did to me? That attorneys can steal from someone they are deposing? That they can threaten someone being deposed with "we will raid you and sue you!"? Is this true? What does an attorney have to do that would prompt an inquiry by the California Bar Association, shoot someone? Kendrick Moxon had the legal power over me to order me to bring certain property, for me to be at a certain place at a certain time, and to spend a number of hours that he deems fit being deposed. I as a citizen have no power in such a situation other than the power to complain to some authority over Mr. Moxon and Mr. Farny. Surely attorneys in such situations do not have carte blanche to steal and threaten people with a raid?? This has been my first taste of the United States legal system and it has left a bitter taste for me. Your letter of January 2 has compounded that greatly.
